TERMS & CONDITIONS

These Terms of Service ("Agreement") govern the access to and use of the certification training modules (the "Services") provided by Wag Works NC ("we," "us," or "our") to you ("you," the "user," or "trainee"). By accessing or using our Services, you agree to comply with and be bound by these Terms of Service.

1. Acceptance of Terms

By accessing or using our training modules, you acknowledge that you have read, understood, and agree to these Terms of Service. If you do not agree with these Terms, you may not access or use the Services.

2. Eligibility

You must be at least 18 years of age, or the legal age of majority in your jurisdiction, to access the Services. If you are under 18, you may use the Services only with the involvement of a parent or legal guardian.

3. License Grant

We grant you a limited, non-exclusive, non-transferable license to access and use the certification training modules for your personal, non-commercial educational purposes, subject to your compliance with these Terms.

4. Account Registration

To access certain features of the Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update your information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Payment Terms

Access to the certification training modules may require payment. You agree to pay all applicable fees for access to the Services as outlined on our website or other communications. Payment must be made in full before accessing the training modules. Fees are non-refundable, except as required by law. Payments remitted online are subject to service a processing fee of 4.9% + .30.

6. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You will not:

  • Engage in any activity that may disrupt or damage the Services.

  • Use the Services for any unauthorized commercial purpose.

  • Copy, distribute, or share the content of the training modules without prior permission.

  • Attempt to reverse-engineer, decompile, or otherwise interfere with the functionality of the Services.

  • Violate any intellectual property rights related to the Services.

7. Intellectual Property

All intellectual property rights, including copyrights, trademarks, and other proprietary rights, in and to the Services, content, and materials are owned by Wag Works NC or its licensors. You do not acquire any rights to the intellectual property through your use of the Services except for the limited license granted under these Terms.

8. Certification

Upon successful completion of the training modules, you may receive a certificate of completion. The certification is solely for educational purposes and does not guarantee employment, professional accreditation, or any other form of recognition, unless expressly stated otherwise.

9. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, including but not limited to violations of these Terms. Upon termination, you must immediately cease all use of the Services.

10. Privacy

Your use of the Services is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. Please review our Privacy Policy. We do not allow undisclosed recording devices during services.

11. Disclaimers and Limitation of Liability

The Services are provided "as is" without any warranty of any kind, whether express, implied, or statutory. We do not guarantee that the Services will be error-free or uninterrupted, nor do we make any representations about the accuracy, reliability, or completeness of the content.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the Services during the three-month period immediately preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Wag Works NC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Services, your violation of these Terms, or your violation of any rights of another party.

13. Governing Law

These Terms will be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Raleigh, NC for any disputes arising from or relating to these Terms.

14. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved by binding arbitration, rather than in court. The arbitration shall be conducted in Raleigh, under the rules of JAMS, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.

15. Amendments

We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our website. You are responsible for reviewing these Terms periodically to stay informed about any changes.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with any other legal notices and agreements published by us on the Services, shall constitute the entire agreement between you and Wag Works NC concerning the Services.

By accessing and using the Services, you acknowledge that you have read and agree to these Terms of Service.
